Billy Green's Trial Delayed

Pocahontas, AR--Billy Green, one of the men accused of murdering an entire family, waived his right to a speedy trial and Judge Harold Erwin moved his day in court to May 10th.

Billy Green, along with his son Chad are each charged with four counts of murder and one count of kidnapping in the 1998 killings of Carl Elliot, his wife, and two young children in Dalton.

Today, Billy sat in Randolph County Court while his lawyers argued 21 pre-trial motions before Judge Erwin.  And for the first time media members got a chance to see some previously sealed investigative documents that show 9 year old Gregory Elliot was found in his living room shot in the head.

One of the search warrants indicates the items taken for analysis from the crime scene included a tire iron, that some speculate may have been used as the murder weapon in Lisa Elliot's death.

Billy Green's lawyers did agree with doctors that Billy is mentally competent to stand trial.  And as it stands right now, there is no motion to move Billy Green's trial out of Randolph County.

Judge Erwin did hear and dispatch all 21 motions today, most of them standard for any death penalty case.
