MARION, AR - A federal appeals court said today it is "troubled" by a judge's decision to dismiss a complaint by an inmate who said Crittenden County jailers repeatedly failed to provide him prescribed medication.
A three-judge panel of the Eighth U.S. Circuit Court of Appeals in St. Louis said in an appeal from Raymond King, Sr. that U.S. Magistrate H. David Young correctly dismissed other claims King made in his lawsuit. But the panel says Young was wrong to rule that King was not harmed when he did not receive blood pressure and pain medication during ten months he was jailed in Crittenden County.
The case was sent back to the magistrate's court for a ruling consistent with the panel's opinion.
King says he repeatedly complained to Chief Jailer Theresa Bonner, Chief Deputy Sheriff Robert Cooper and Jail Administrator Robert Harper that he needed the medicine.
Bonner declined to comment today. Harper no longer works at the jail. Cooper is deceased.
