Twice fired ASP Trooper reinstated for 2nd time

LITTLE ROCK, AR (KAIT) – The Arkansas State Police Trooper involved in a fatal accident in Manila has once again been reinstated to the force.

Lawyers for Andrew Rhew argued his firing was unjustified, because the victim in the accident was to blame.

According to Robert Newcomb, attorney for Andrew Rhew, say Vickie Freemyer was going at least 8 mile per hour, if not more, and going through a stop sign.

Freemyer was killed in the November 3rd, 2009 accident. According to police Rhew was southbound on Highway 77 when his marked patrol car and Freemyer's vehicle collided. Police determined Rhew was speeding and not running his siren or flashing lights at the time of the accident.

Newcomb also claims that the initial report from the state crime lab indicated that Freemyer's drug levels were such that she was moderately impaired.

Rhew was fired in December, but reinstated in March after his attorney argued no decision on his employment should be made until after his criminal trial.

Rhew pleaded no contest to a negligent homicide charge in April, and then fired again in June. On Thursday afternoon he was once again reinstated to the ASP force.
