BROOKLAND, AR (KAIT) – The man who's been held in the fatal shooting of a man in Brookland is being released and no charges will be filed.
According to the Craighead County Sheriff's Department, Allen Petty was released from the Craighead County Jail Wednesday afternoon.
The sheriff's department and prosecuting attorney say there is not enough evidence to support an arrest for murder. They say at this point, the shooting was in self defense however the sheriff's department is still investigating the relationship between Petty, the homeowner and the victim.
"The Jonesboro Dispatch Center received a 9-1-1 call from an individual who said he had shot a person," said Craighead County Sheriff, Jack McCann. Authorities say it happened at 110 Christy Street. "The shooter was in the front yard, and arrested without incident." said McCann.
"The shooter was there working. He was actually painting the interior of the residence," said McCann. McCann says the victim apparently forced his way into the home, there was an altercation and he was shot multiple times. Authorities say the woman who lives at the home was not there at the time."That's what we're trying to determine is the background to this incident."
Sheriff McCann is not releasing the victims name.
