Court Dismisses Paragould Woman's Wal-Mart Suit

LITTLE ROCK, Ark. -- The Arkansas Court of Appeals Wednesday dismissed an appeal by a woman who had sued Wal-Mart after slipping and falling on a store's floor.

Stacy Wineland had filed a negligence suit after slipping on a recently mopped floor in a Paragould Wal-Mart.

The circuit court granted Bentonville-based Wal-Mart summary judgment in the case, finding that the cleaning crew, United Janitorial Services, was operating as an independent contractor.

Wineland appealed, arguing that the contractor issue had not been resolved and that Wal-Mart was negligent for not supervising the cleaning crew and for violating health and safety standards.

Wal-Mart responded that the appeal should be dismissed because the woman's claim against United Janitorial Services is not resolved.

The state appeals court said it agreed and dismissed the appeal.
