Charges Dropped In Freak Accident Death of Cave City Teen, But...

CLARKSVILLE, Ark. -- A prosecutor said today that a charge against a truck driver involved in a fatal accident last month has been dropped, but the state will investigate to see whether a more serious charge is appropriate.

Police say a 60-pound electrical component fell from a truck last month and hit an SUV, killing a Cave City teenager who was traveling on Interstate 40.

Gary Lee Summers, who drives for a Morrillton company, had been cited for failing to secure his load.  A court hearing was scheduled for Johnson County Circuit Court today, but deputy prosecutor Bruce Wilson said the citation was dropped pending a further investigation.  Prosecutors may consider upgraded charges.

The accident on July 25th killed Robert E. McCracken, who was 15.  He was a member of the Mount Pleasant High School basketball team and the Future Farmers of America.

The accident occured in a construction zone, where eastbound and westbound traffic are separated only by a concrete barrier.
