Prosecutor’s office says FBI justified in Osceola shooting

OSCEOLA, AR (KAIT) – Mississippi County Prosecuting Attorney Scott Ellington has ruled that an FBI agent was justified in the shooting and killing of an Osceola man.

According to a press release from Ellington's office, FBI agent Ryan Barrett was justified in the shooting death of Brandon Fountain on February 8 in Osceola, and no charges would be filed.

According to police, several agencies were at Fountain's home to question him about a child pornography investigation.

Police say they questioned Fountain in his home on Cheryl Street in Osceola, and confronted him with information identifying him as a person who sent an e-mail correspondence pertaining to child pornography to Bloomington, Indiana. Police say he admitted to being in possession of more than one thousand images of child porn, and confessed to abusing two or three children belonging to friends of friends.

Investigators say while preparing paperwork for Fountain to sign to search his home, he asked to use the bathroom. Police say instead of going to the bathroom, Fountain ran to the bedroom and pulled a .45 caliber pistol from the nightstand. FBNI agent Barrett yelled for Fountain to put the gun down and put his hands up, but Barrett said he made a turning motion and he fired two shots into Fountain's back. Fountain was killed in the shooting.

Ellington said, "Special Agent Barrett was entirely justified in protecting himself and his fellow officers from Mr. Fountain and his pistol," Prosecutor Ellington said. He went on to say, "I hope the Fountain family and all of the officers involved will soon heal from the trauma of February 8th." In the release Ellington said Fountain's gun was loaded and ready to fire.

Arkansas State Police, Kokomo, Indiana Police, Brownsburg, Indiana Police, and the FBI all assisted in this case.
