Boll Weevil Lawsuit

A Judge has declined to dismiss a lawsuit contesting the state's right to force farmers into a Boll Weevil eradication program.

Pulaski county circuit Judge Jay Moody says that both sides have good arguments that should be heard.

So Moody scheduled a trial of the case to begin December 1st.

The state plant board is being sued by a group of Northeast Arkansas farmers that the board has forced to join and pay for an eradication program.

6 farmers sued, saying the board illegally instituted the fees.
