Boyfriend of slain beauty queen sues prosecutor

LITTLE ROCK, Ark. (AP) - The boyfriend of an Arkansas beauty queen who was killed 2005 has filed a civil lawsuit against the special prosecutor in the case.

Kevin Jones was acquitted in 2007 in the beating death of Nona Dirksmeyer. He wants special prosecutor Jack McQuary to provide documents related to the current case against Gary Dunn. Since Jones' acquittal Dunn was charged and twice tried for capital murder in Dirksmeyer's death with both trials ending with a deadlocked jury.

He's to be tried a third time starting Aug. 1.

The lawsuit was filed Wednesday in Pulaski County by attorney Charles Gibson. Phone calls to Gibson went unanswered Friday and Saturday.

McQuary told the Arkansas Democrat-Gazette that he had no notice of the lawsuit and would not turn over the documents because the investigation is ongoing.
