Three Region 8 Counties Involved in White River Dredging Lawsuit

LITTLE ROCK, AR - A gravel-mining company is suing the Army Corps of Engineers, saying that the government shouldn't ban dredging on the White River during the spring.

Mobley Construction claims that there's no scientific evidence that supports the ban, which is in place in the springtime to protect the spawning grounds of paddlefish and other species.

The suit asks the court to overturn the ban.  Mobley asked for a hearing on the matter before January 15, the date the permit expires.

The suit claims that the company had been dredging parts of the White River in Jackson, Woodruff and Independence counties for more than 70 years.  Not until 1995 did the Army Engineers add a provision to the company's dredging permit that barred dredging in the springtime.
