Hearing delayed for ex-Ark. MD charged in deaths

CONWAY, Ark. (AP) - A hearing on a defense motion to dismiss capital murder charges against a former doctor has been postponed.

The Faulkner County Circuit Court hearing in the case of Richard Conte had been set for Wednesday, but Prosecuting Attorney Cody Hiland told the Arkansas Democrat-Gazette (http://bit.ly/xKSraP) Friday the proceeding will take place March 30.

Conte was charged last year with two counts of capital murder in the May 2002 fatal shootings of Carter Elliott and Timothy Robertson. Authorities had Conte extradited from Nevada where he had just completed a kidnapping sentence for abducting Lark Gathright-Elliott, who was former wife of Carter Elliott and Conte.

Conte's attorney, Jack Lassiter, has argued that Hiland's predecessors reviewed the case and declined to charge Conte.

He didn't immediately return a message left Saturday seeking comment.
