Penalty Phase to Continue in Green Trial Today

MAY 24, 2004 - Posted at 6:59 a.m. CDT

POCAHONTAS, AR - The penalty phase resumes today in the capital murder trial of a Warm Springs man found guilty in the deaths of four family members from Randolph County.  Prosecutors are seeking the death penalty.

A jury convicted Billy Dale Green on Friday.  Prosecutors and the defense made opening statements in the penalty phase later Friday and testimony began before the recess for the weekend.  Proceedings are to resume today.

The 49-year-old Green was convicted of four counts of capital murder in the deaths of Carl Allen Elliott, his wife and their two children.

Witnesses said Green had had a dispute with Elliott over drugs and killed the family the night of July 29, 1998.
