LEACHVILLE, AR (KAIT) – Two people in the car with Jerry Lard when he shot and killed Trumann Police Officer Jonathan Schmidt appeared in court Monday.

According to the Mississippi County District Court's Office, Brian Elumbaugh and April Swanner had their case bonded over to the Circuit court and will appear at a later date. 

Both were arrested on meth charges on November 15, in Leachville.

According to Leachville Police, around 10:30 Thursday morning Brian Elumbaugh and April Swanner sold 2.4 grams of meth to an undercover police officer. Both were immediately arrested after the sale.

Elumbaugh and Swanner face charges of delivery of a control substance (meth), possession with intent to deliver a controlled substance (meth), and endangering the welfare of a minor.

Both are being held without bond in the Mississippi County Detention Center.

On April 12, 2011, Elumbaugh and Swanner were the driver and passenger of a car in Trumann when they were pulled over and arrested for outstanding warrants.

In the backseat of the car was 38-year-old Jerry Lard who jumped out of the car and began firing at Trumann Police Officers Jonathan Schmidt and Corey OverStreet.

According to the arrest affidavit in 2011, an investigator was told Lard said repeatedly before getting out of the car, "Today is the day." Court documents suggest when Schmidt opened the car door; Lard got out with a gun in his right hand and shot Schmidt at close range.

Schmidt was killed in the shooting.

In August of 2012, Lard was later found guilty of his murder, and was sentenced to death by lethal injection by the jury.

Both Elumbaugh and Swanner testified in the trial against Lard.

Leachville Police were assisted in the arrest by the 2nd Judicial District Drug Task Force, and the Mississippi County Sheriff's Department.
