Judge Refuses to Toss Out Lawsuit on Grand Prairie Irrigation Project

JULY 26, 2004 -  Posted at 1:45 p.m. CDT

LITTLE ROCK, AR - A judge today refused to dismiss a lawsuit that claims the wrong state agency is handling a proposal to pump water from the White River for irrigation.  The Arkansas Wildlife Federation says the Arkansas Game & Fish Commission should have jurisdiction over the Grand Prarie Irrigation Project, not the state Soil & Water Conservation Commission.

The soil and water panel entered an agreement with the Corps of Engineers to allow the pumping of water from the White River for farms.  The Wildlife Federation sued, and today Pulaski County Circuit Judge Willard Proctor refused to dismiss the lawsuit.

Proctor says more information is needed in the case.
