Federal Appeals Court Upholds Firing of Marion City Employee

MARION, AR - A Marion city worker lost a federal appeal today of his firing by the city.

George Beasley claimed he was wrongly fired because he had a disability.  But the Eighth U.S. Circuit Court of Appeals in St. Louis agreed with city officials.  The city claimed Beasley abandoned his job by failing to stay in touch with his boss after leaving for two weeks after an injury.

According to the court, Beasley injured a knee after slipping on ice while doing welding work for the city.  A medical specialist advised Beasley not to work for two weeks.  But the court ruled Beasley didn't return to work, and effectively abandoned his job.

Beasley also admitted to working in car repair and furniture delivery after his injury and presented no evidence that the city ever considered him as being substantially impaired.
