Charges filed in Mountain Home shooting

MOUNTAIN HOME, AR (KAIT) – One man is in the hospital after being shot during a fight with another man in Baxter County.

According to the sheriff's office, a fight broke out between 49-year-old James William Kirk and 58-year-old Gregory Milo High at a property on Canvasback Drive in Mountain Home.

Deputies say High found Kirk living in one of his shop buildings.

Police say Kirk hit High with a wrench and High fought back, shooting Kirk in the leg with a pistol.

Investigator Sergeant Brad Hurst found Kirk called High's wife and claimed three different times he was going to kill High.

Sgt. Hurst also found Kirk fired a shotgun after he heard a noise.

Sgt. Hurst also found Kirk was a convicted felon and was not allowed to possess or use any kind of firearm.

Kirk now faces felony charges for battery, terroristic threatening, and possession of firearm by a convicted felon.

He was set to appear in court for misdemeanor charges of criminal trespass on October 12. Now, he is set to appear in court on October 17 on the felony charges.

He is being held in lieu of a $25,000 bond.

Both men were taken to the Baxter County Regional Medical Center. Kirk is in the ICU with non-life threatening injuries.

Deputies say it's unclear what exactly started the altercation.
