No Effort Planned in Legislature to Cap Liability for Care Facilities

LITTLE ROCK, AR - A top nursing home official says no bill is being prepared to limit damages in lawsuits against the elder care facilities.

A measure to cap punitive damages that could be awarded against nursing homes at $1 million failed to clear the 2003 legislative session.

A nursing home trade group says the issue is too controversial and the Arkansas Health Care Association is not pushing for a bill this session.  The group is waiting to guage the effect on insurance rates of a broader bill that did pass the last legislative session.  That new limits liability in damage suits.
