Prosecutor asks federal charges be dropped against 3 Region 8 men

JONESBORO, AR (KAIT) - A federal prosecutor filed motions Wednesday asking that federal child enticement indictments be dropped against three Region 8 men.

Kenneth Wayne Thompson, 23, of Bradford; Benjamin Cade Vardell, 20, of Jonesboro; and Lukus Aaron Oden, 20, of Paragould were each indicted on one count of using facilities and means of interstate commerce to entice a minor to engage in sexual activity.

Last week all three defendants pleaded guilty to sexual assault in the second degree and were sentenced in Craighead County Circuit Court.

On Wednesday, Christopher Thyer, U.S. Attorney for the Eastern District of Arkansas, filed motions asking the federal indictments be dropped.

In his motions, Thyer stated he did “not believe that justice will be done in these cases by continuing these federal prosecutions.”

While Thyer stated he was “firmly convinced” the defendants' conduct was “unlawful,” he said he did not believe a federal conviction and the 10-year mandatory minimum sentence “would serve the ends of justice.”

He concluded by stating, “While neither I personally nor any member of my office took any position on the sentences received by these defendants in state court, I personally believe that they were appropriate based on the facts of the cases as I know them.”
