Man accused of biting off brother's thumb during argument

JONESBORO, AR (KAIT) - Police arrested a Jonesboro man after they say he tried to bite off his brother's thumb during an argument.

According to the initial incident report, 37-year-old Brian Allen Swindle and 40-year-old Kevin Edward Swindle were traveling with their mother on Harrisburg Road shortly before 11:30 p.m. Tuesday when they began fighting about the car radio.

Brian Swindle told Officer Joe Robinson he was in the front seat when his brother Kevin grabbed him around the neck from the back seat.

While his brother had him in a "head lock," Swindle said his older brother tried to gouge out his right eye.

Officer Joe Robinson stated Swindle's "eye was very red and appeared to have scratches on his eyeball."

Brian Swindle said during the struggle Kevin Swindle bit his thumb. It was at that point the younger brother got out of the car and walked to his mother's apartment on Burns Circle.

After stating he could not move or feel his thumb, Swindle was taken by ambulance to a local hospital. According to the report, EMS stated he may have sustained "permanent damage to his thumb."

The report stated officers found Kevin Swindle behind his mother's home, sitting beside the air conditioning unit, with 2 puppies inside his shirt. He was arrested and taken to the Craighead County Detention Center where he was cited and held without bond on a charge of second degree domestic battery.

According to documents from the sheriff's department, at his probable cause hearing on Wednesday the charges were reduced to domestic battery-third degree. His bond was set at $5,000 bond.
