Elementary teacher formally charged with sexual assault of former student

A Salem school teacher has been formally charged after a girl told police he touched her.

Sixth grade teacher David Thomas Cone, 38, of Melbourne was charged with felony sexual assault second degree Monday, according to the Fulton County Sheriff's Office.

In a news release Tuesday Chief Deputy Al Roork states Cone was taken into custody Aug. 28. He was released on Monday after posting a $25,000 bond.

Salem School District Superintendent Ken Rich said Monday a 6th grade teacher was placed on leave and since the case is a personnel matter, he could not release much more.

Roork said the investigation is ongoing.

The victim, now 17 years old, told a special agent with Arkansas State Police that Cone "fondled her buttocks" on at least two occasions when he was her teacher between 2008 and 2009, according to court documents.

The girl also told police the incidents happened once at her house and once at her friend's house, both in Fulton County.

The court document shows ASP interviewed Cone on the same day he was arrested. He told the special agent he did on one occasion in 2008 or 2009 "intentionally put his hand on the buttocks of the alleged victim" at a friend's house. 

Cone is expected to be in circuit court on Sept. 23.
