City lawsuit halts pond construction

GREENWAY, AR (KAIT) -

A lawsuit by the city of Greenway has halted the plans of a pair of people and their installation of several ponds.

The lawsuit was filed to stop the digging on six separate lots.

Mark and Christian Foster own four of the lots and Brian Waddell owns two.

Foster started clearing the lots and in mid-April he started digging large holes, according to a suit filed in Clay County Circuit Court.

Several neighbors were told the holes would be ponds, which left many people in the city upset.

A total of 88 people in Greenway signed a petition to stop the construction.

The lawsuit from the city followed the petition.

People in Greenway told Region 8 News they are concerned the pond will bring unwanted insects and cause several safety hazards.

“It is going to bring in a lot more mosquitoes, more snakes and I am just scared for my grandchildren,” neighbor Edna Shaw said.

The city complaint also stated the holes could cause health and safety risks along with several city and state violations.

A temporary injunction has been filed to stop construction.

A hearing regarding the issue is set for May 20 at the Clay County Eastern District Court in Piggott.
