JONESBORO, AR (KAIT) -

A Greene County man will appear in Craighead County District Court Oct. 12 after leaving a dog inside a hot car Wednesday, Jonesboro police said.

Tory A. McFadden, 29, of Paragould was cited for cruelty of animals and no rabies tag after Officer Eric Schmett went to the parking lot of TJ Maxx on South Caraway Road.

Schmett said he saw a white Jeep Patriot with a dog inside and the windows of the vehicle cracked.

"The dog was panting," Schmett wrote in the report. "I observed a Styrofoam cup in the vehicle, but it did not appear to have any water."

The temperature outside was 90 degrees, but it was 106 degrees near the roof and 100 degrees in the center of the vehicle, according to the report.

After about 25 minutes, McFadden came out of the store and told police that the dog and vehicle belonged to him.

"I asked him how long he had been inside, he stated, 'five minutes,'" Schmett wrote in the police report.

When asked how hot he thought it was inside the vehicle, McFadden answered "I'd say over 100 degrees."
