CHEROKEE VILLAGE, AR (KAIT) - A Cherokee Village man and his wife face multiple charges after investigators say he raped a young girl and his wife did nothing to stop it.
Sharp County sheriff's deputies arrested Albert Scott Maxon, 40, on three counts of rape after he reportedly admitted to having sex multiple times with a 13-year-old girl. They also arrested his wife, 39-year-old Janis Maxon, on three counts of permitting abuse of a minor after she told investigators she knew about the incidents but didn't call the police.
On Feb. 17, the victim told a counselor at her school that Maxon had been having sex with her and that his wife "knows about it and won't do anything," the incident report said.
After hearing the child's allegations, the counselor notified the school's resource officer, Deputy Jeremy Stevens, who contacted an Arkansas State Police Crimes Against Children Division investigator.
The girl told Stevens and the ASP investigator that Maxon has had sex with her several times in the past few months. She added that Maxon "won't stop touching me."
The victim said she told Maxon several times to stop, "but he won't."
After interviewing the victim at the school, Stevens contacted Albert and Janis Maxon and arranged to meet them at the Department of Human Services office.
When the couple arrived at the DHS office, Stevens and the ASP investigator met with Albert Maxon, who agreed to answer their questions after being read his Miranda rights.
"Albert was adamant that he had never touched her in a manner that was sexual, not even by accident," the report stated. "Albert told us he only has sex with his wife."
After being questioned multiple times about the allegations, Maxon then told the investigators he "never forced" the girl and that the sex had been consensual.
According to the incident report, Maxon said he and the 13-year-old victim had been "goofing and playing around on the bed." He told police both he and the child were naked.
"I laid down and she was all over me," Maxon reportedly said.
When asked if they had sex, Maxon replied: "Pretty much."
Initially, he claimed they only had sex one time then changed it to three times.
"[Maxon] told us his wife (Janis) knows about it, and she doesn't like because she thinks it's not right," Stevens noted in his case report.
After interviewing Maxon, the investigators spoke with Janis Maxon. According to the report, Stevens heard her husband tell her to "not lie" and "tell the truth."
After advising her of her Miranda rights, the investigators asked Janis Maxon if she knew about the alleged sexual assaults. She replied with "I don't know."
The officers then told her they knew.
She reportedly admitted to knowing what happened between her husband and the child, but said Maxon threatened to hurt her if she told anyone.
Janis Maxon "admitted to seeing one of the sexual encounters," the report stated. When she threatened to call the cops, she said Maxon "told her not to because he wouldn't do it again."
"She admitted to knowing it happened several times and did nothing about it," the report stated. "Janis showed no remorse about the incidents that occurred."
After interviewing the couple, Stevens and the ASP investigator met with a DHS agent and told them to take custody of the Maxon's three children.
Stevens then arrested Albert and Janis Maxon. He took them to the Sharp County Sheriff's Department to await the filing of formal charges.
