LITTLE ROCK, AR (KAIT/KATV) - An Arkansas judge has set a trial date for a Little Rock man charged in the 2016 death of a toddler.
According to KATV, Gary Eugene Holmes, 34, appeared in court Monday.
Holmes is facing a charge of first degree murder and terroristic threatening after police say he fired a gun killing 3-year-old Acen King sitting in the back seat of his grandmother's vehicle. The shooting occurred while the vehicle was stopped at a stop sign.
The trial was pushed back last month after Holmes attorneys sought a mental evaluation for their client. State doctors declared Holmes fit to stand trial when he was initially charged.
The toddler's grandmother is showed frustration with the time line of events Monday, saying "He did't need a mental evaluation. He knew exactly what he was doing"
Holmes trial date is set for August 21-23, 2018.
