Judge grants request to dismiss JPD from lawsuit

The Jonesboro Police Department has been removed from a lawsuit filed by a man's family in connection to his April 2015 death.

Christopher Grant Finley's family filed the lawsuit against Officer Heath Loggains, the City of Jonesboro, the Jonesboro Police Department, Chief Rick Elliott and several other unnamed officers listed as "John and Jane Does I-VIII."

Attorneys for the city of Jonesboro filed a motion on May 17 seeking to remove the Jonesboro Police Department from the lawsuit saying "There is no statute or ordinance making the Jonesboro Police Department a legal entity separate from the city of Jonesboro itself," the attorneys wrote in the motion.

In a joint move, attorneys for both the city and Grant Finley's family filed a motion to formally dismiss JPD from the suit. On May 25, Judge D. P. Marshall Jr. granted the request.

Officer Heath Loggains, the City of Jonesboro, Chief Rick Elliott and the unnamed officers remain on the lawsuit.
