Arkansas Farmers File Lawsuit in Boll Weevil Program

September 10,2005 - Posted at 11:50p.m. CDT

LITTLE ROCK (AP) -  Northeast Arkansas farmers have filed another lawsuit to stop the state from forcing them to pay into a boll weevil eradication program.

The lawsuit, filed in Pulaski County Circuit Court, says the Arkansas State Plant Board can't impose the fees without the cotton farmers agreeing by a vote to participate in the program.

The suit challenged a decision in June by the Plant Board, authorizing the eradication program in the Northeast Delta Zone fora third straight year. The zone includes Mississippi County and Craighead County, east of the Saint Francis River. Two similar lawsuits are on appeal to the Arkansas SupremeCourt.

The court is to hear arguments Thursday.
