Ballot Proposal Seeks Eminent Domain Restrictions

JEFFERSON CITY, MO - A new ballot proposal seeks to restrict the use of eminent domain and provide money to people whose property values decline because of government regulations.

The proposal was submitted to the secretary of state's office today by Kansas City resident Patrick Tuohey.

State legislators also are considering restrictions on eminent domain following a U.S. Supreme Court decision last year.  That ruling upheld the condemnation of private property so it could be transferred to a private developer who would generate more tax revenues.

The ruling has been criticized be elected officials and property rights advocates.

If approved for circulation, the ballot initiative would need petition signatures from about 145,000 people to make the November ballot.
