February 18, 2006-- Posted at 3:15 pm CST

GREENE COUNTY-- A ruling by the federal appeals court yesterday says Greene County Sheriff Dan Langston cannot be sued in the death of a mentally ill inmate.

The appeals court said that without some indication that Sheriff Langston intentionally ignored the inmate's constitutional rights, the sheriff has immunity from the a lawsuit.

The sister of inmate Phil Edward Blount, sued the sheriff, the county and 10 unnamed sheriff's department employees over the January Fifth, 2002, death of her brother.

46-year-old Blount died after he reportedly drank some shampoo and began vomiting.

The lawsuit claims the county failed to respond to requests from Blount, Vaughn and Blount's mother to get medical attention for him.
