GARDEN CITY, NY - Court documents show one of the Duke University students accused of raping a woman was arrested six months ago in Washington, DC, an an alleged gay-bashing incident.

A man says he was punched repeatedly by Collin Finnerty and two of his high school lacrosse teammates who spouted anti-gay insults.

Finnerty is in a diversion program, which will dismiss the charges after he completes 25 hours of community service.

Finnerty and Reade Seligmann were arrested today on charges of kidnapping and raping a dancer at an off-campus party in North Carolina.

Both men grew up in swanky suburbs of New York City.  Both went to pricey prep schools amid golf courses and multi-million dollar homes.

The headmaster of Seligmann's $22,000-a-year high school says he thinks the 20-year-old is "innocent of the charges."

And Finnerty's coach at Chaminade High School on Long Island says his former player "was good enough" on the field and in the classroom to go to Duke.
