Court Upholds Defamation Ruling Against Private School in Region 8

JUNE 30, 2006 - Posted at 7:44 a.m. CST

LITTLE ROCK, AR - The state Supreme Court agrees with a lower court that said a private school in St. Francis County defamed a student who was expelled after he found a video camera in a changing room.

But the court dismissed breach of contract and contract-interference rulings against Calvary Christian School in Forrest City.  The high court said the contracts were based on biblical principles and outside the lower court's jurisdiction.  The court also reversed an outrage ruling against the school.

In an appeal, the school argued that the contract issues were outside the circuit court's jurisdiction because the school was a private, religious institution.  The Supreme Court agreed.

But the court upheld the defamation verdict, saying that the school didn't provide enough evidence to overturn the claims that a principal called the boy a liar and claimed he had used an obscene gesture.
