U.S. Seeks Custody of Missouri Marine Convicted of Rape in Philippines

MANILA, Philippines (AP) - The U.S. government is seeking custody of a St. Louis Marine convicted of rape in the Philippines, but a Manila judge will have to decide.

The legal battle over custody and interpretations of a military pact comes a day after Lance Corporal Daniel Smith was convicted of raping a 23-year-old Filipino woman.

Smith had been in U-S Embassy custody during his trial. But he spent his first night in a Manila jail after his guilty verdict was announced.

The U-S military argues it should have custody of Smith during his appeal but added that that transfer can come only through authority of the Filipino courts.
