High Court Upholds Class-Action Status Against Batesville Nursing Home

LITTLE ROCK, AR - The Arkansas Supreme Court yesterday upheld the class-action status of a lawsuit filed by 489 people who accuse a Batesville nursing home of violating their rights.

Justices upheld an Independence County Circuit Court's decision to certify the lawsuit against the former Beverly Enterprises Incorporated and its facility in Batesville.  The Fort Smith-based nursing home company was sold last year to a San Francisco-based investment group.

In the lawsuits, the residents claim that the nursing home between 2000 and 2004, violated the rights of its patients by not providing proper care and staffing at the facility.

Beverly appealed the class certification and said the questions in the lawsuit would require individual cases.
