CAPE GIRARDEAU, Mo. (KFVS) - A former deputy clerk is taking legal action against Stoddard County and the Stoddard County clerk after being fired from her position in April.

Ginger McCoy filed a civil suit one month after blowing the whistle on the April Election in Stoddard County, in the suit she claims she was wrongfully terminated.

“She blew the whistle on some election irregularities that could have been felonies that occurred after the April 2 Stoddard County Election and she was fired for it,” said Laura Clubb from The Clubb Lawfirm. She represents McCoy.

“The case that we filed in Stoddard County yesterday is under the Whistle Blower protection act that protects our public servants from being fired or being disciplined for trying to report a violation of law,” said Clubb.

In the suit, McCoy claimed she lost her job after telling county clerk Cecil Weeks about “election irregularities” in Dexter’s Ward Two and certifying the election could break the law.

“And her reward for trying to keep our elections fair and make sure every vote is counted...she got fired,” said Clubb.

McCoy also filed a discrimination charge against Weeks with the Missouri Department of Labor.

She claimed she was subjected to sexual harassment and a hostile work environment.

“It saddens me personally as a voter to think that somebody sees something wrong and then they get fired for saying something about it because that makes me wonder how many people may have seen something that really needs to be looked into and now they’re afraid to say anything about it,” said Clubb.

We reached out to presiding commissioner Danny Talkington and he said he hasn’t seen the filings and can’t comment on them until he does.

We also reached out to Weeks, he has not returned our call.
