Sexual assault charge dismissed after prosecutors unable to prove case

JONESBORO, Ark. (KAIT) - A man accused of fondling another man while fitting him for a back brace no longer faces charges after prosecutors could not prove it happened.

Second Judicial Circuit Court Judge Randy Philhours signed an order of nolle prosequi on Thursday, May 28, dismissing one count of second-degree sexual assault against Bryan Fairbanks.

The order stated that the prosecution was “unable to prove this case beyond a reasonable doubt.”

Police arrested Fairbanks in 2024 after a man claimed Fairbanks inappropriately touched his genitals during a back brace fitting at a Jonesboro prosthetics company.

According to court documents, Fairbanks was fired following the allegation.
